My Pace

1. GENERAL

 

These terms and conditions apply to all services provided by My Pace; in particular to classes, sessions and workshops (hereafter collectively referred to as "events") at all locations, where they are led by My Pace. By booking or taking part in one or several events you accept the following terms and conditions.

2. RIGHT OF USE

 

Services offered by My Pace are in principle open to all interested parties. However, there is no legal claim to these services. If special personal conditions are required for a particular service, these must be met by the customer. My Pace and its representatives reserve the right to refuse interested parties prior to the provision of the service without giving reasons or to subsequently terminate the contractual relationship due to non-fulfilment of participation requirements.

3. TERMS OF PAYMENT AND CANCELLATION

Booking and payment of events are completed online. Cancellation without a cancellation fee is possible only up until 24 hours prior to begin of the booked event. In the case of a series of events booked collectively, fee free cancellation is possible only until 24 hours before the begin of the first event in the series. Cancellation after such a point will be penalised with a fee of 100% of the event fee. Partial participation in an event does not entitle the participant to a payment reduction or refund of any kind. A substitute participant can be provided at any time and this will negate any cancellation fee. My Pace must be informed of such a substitution in writing (e.g. by letter, or e-mail) prior to the begin of the event and the substitute must be made aware of all terms and conditions of participation by the customer.

4. CANCELLATION, TERMINATION OR CHANGES BY MY PACE

The execution of an event is bound to the achievement of a minimum number of participants by a certain deadline. If the number of participants is insufficient, the event can be changed, postponed or cancelled. My Pace reserves the right to postpone, interrupt or cancel an event or series of events at short notice for good cause. Participation fees already paid will be refunded in full or, at the customer's request, the existing booking can be re-issued in the from of a replacement event. Further claims for damages are excluded.

5. ARRIVAL TO EVENTS

 

Customers commit themselves, through the booking of an event with My Pace, to arriving to the event on time. Access for all participants is only possible until the beginning of the event. There is no entitlement to later access and participation in a session that is already in progress.

6. HEALTH OF CLIENTS​

​

Each customer bindingly declares with their registration that they are physically healthy and mentally stable as well as able to cope with the relevant physical and mental requirements of the booked event. They further declare that they shall only begin or continue participation in any event as long as they are in such a state. Participation in events offered by My Place under the influence of drugs, alcohol or medicines that my impair their ability to participate or make sound judgment about participation is prohibited. Chronic diseases and other physical or mental conditions, which could affect or endanger any participant (including the customer), must be reported to the instructor(s) before the start of each session. The services offered by My Pace are not to be understood as therapy or a healing program. They in no way replace medical care or prescription of medication. In case of doubt, a physician should be consulted.

7. EXCLUSION OF LIABILITY​

​

The liability of My Pace and its representatives for personal injury, financial loss and property damage is limited to intent and gross negligence. My Pace is not liable for the consequences of improperly performed exercises.

 

Liability in the event of loss or damage of any items or belongings brought to events is also excluded.

 

The use of all services offered by My Pace is at the participant's own risk. My Pace and its representatives are exempt from any liability claims in this regard and therefore not liable for accidents or resulting physical damage to customers. Each customer bindingly declares with the registration that they accept this and that they have personal liability and accident insurance covering their participation in the events offered by My Pace. Further, they accept that My Pace will not be held liable in any case of insufficient coverage by insurance policies. My Pace and its representatives will not accept any liability toward third parties.

My Pace and its representatives perform the individual services professionally and conscientiously in accordance with the principles of proper execution and, in so doing, strives to ensure the accuracy and completeness of the content and information provided within the scope of its services. However, no guarantee can be given for the topicality, correctness, completeness or quality of the information provided. Liability claims against My Pace regarding damage caused by the use of any information provided, including any kind of information which is incomplete or incorrect, will therefore be rejected unless My Pace can be proven to have acted with intent or gross negligence.

8. CONFIDENTIALITY AND DATA PROTECTION

 

Personal and company-related customer data will be collected, stored and processed in accordance with data protection regulations and will not be passed on to third parties. Confidential information of the clients that becomes known in the course of the cooperation will be treated strictly confidentially.

9. FINAL PROVISIONS

 

There are no additional agreements. Changes require the written form. We reserve the right to correct errors as well as misprints and miscalculations.

 

If individual clauses of these terms and conditions should be or become in whole or in part ineffective, the validity of the remaining clauses shall remain unaffected and the principle of this contract shall be preserved, whereby the ineffective clause shall be replaced by an effective one, which comes next to the economic purpose of the ineffective clause. The requirement of written form shall be met by electronic transmission, such as e-mail. All messages between the contracting parties may be sent by email, if the client provides an email address.
